1. Agreement to Terms

By accessing or using the BetterMCAT platform, website, and services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and BetterMCAT ("Company," "we," "us," or "our").

2. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use this Service. By using the Service, you represent and warrant that you meet these eligibility requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscription and Payments

Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees as described at the time of purchase. Subscriptions automatically renew at the end of each billing period unless you cancel prior to the renewal date. All fees are non-refundable except as expressly stated in our refund policy or as required by applicable law. We reserve the right to change our pricing with 30 days' prior notice.

5. Free Diagnostic and Trial Services

We may offer free diagnostic tests or trial access to certain features. These are provided "as is" without any guarantee of continued availability. We reserve the right to modify, limit, or discontinue free services at any time without notice.

6. Intellectual Property

All content, materials, features, and functionality of the Service — including but not limited to questions, explanations, study materials, software, text, graphics, logos, and images — are owned by or licensed to BetterMCAT and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Service without our prior written consent.

7. Acceptable Use

You agree not to:

  • Share, distribute, or make available any Service content to third parties
  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Use automated tools, bots, or scrapers to access or collect data from the Service
  • Share your account credentials with others or allow multiple users on a single account
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Post or transmit any harmful, threatening, or objectionable content

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. BETTERMCAT IS NOT AFFILIATED WITH, ENDORSED BY, OR ASSOCIATED WITH THE ASSOCIATION OF AMERICAN MEDICAL COLLEGES (AAMC). MCAT IS A REGISTERED TRADEMARK OF THE AAMC. WE DO NOT GUARANTEE ANY SPECIFIC SCORE IMPROVEMENT OR OUTCOME ON THE MCAT EXAMINATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERMCAT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless BetterMCAT and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
